It is an important document for employers in Canada that is required before hiring a foreign worker. The LMIA or Letter of Evaluation indicates that during the period the employer was aware of the recruitment, no suitable Canadian person has applied for the job and that staff from abroad is required. This letter is issued by the Employment and Development Agency in Canada and allows the employer to hire foreign workers. The LMIA is registered by the employer at the CIC, and upon receipt, the foreign worker will be allowed to apply for a work permit.

 

How do we know if we need an LMIA to hire a new staff?

  • An LMIA is required if you are applying for a Temporary Foreign Employment Program (TFWP). Once this permit is obtained, a copy of the confirmation letter will be provided to each foreign worker so that they can apply for a work permit.
  • You do not need an LMIA if you are applying for an International Mobility Program. You also do not need an LMIA for IMP to hire a French-speaking foreign language.
  • If you are an employer in Quebec and have applied for a temporary foreign employment program, you will need to obtain another document called a Quebec Work Permit (CAQ) from the Quebec Labor Office (MIFI) instead of an LMIA before you can apply for a work permit. .
  • If an employer in Quebec applies for an IMP program, they do not need to provide an LMIA or CAQ.
